Fiancé(e) Visa (K-1 Visa)

The K-1 visa is a non-immigrant visa for a fiancé(e), which grants the right to stay in the U.S. for up to 90 days, with no option for extension. During this period, the couple must get married. If they do get married, the spouse can apply for a change of status. Otherwise, they must leave the U.S. when the visa expires.

A U.S. citizen has the right to file a petition and request a visa for their fiancé(e), provided that they marry within 90 days after arriving in the U.S. Both individuals must be legally free to marry. If the fiancé(e) has minor children, they can also apply for a K-2 visa.

The K-3 visa allows the spouse to enter the U.S. while waiting for the decision on their immigrant visa petition. Therefore, one of the requirements for the K-3 visa is the submission of a petition by the U.S. citizen spouse, and the applicant must meet specific conditions to be eligible for this visa.
